By using our services, you agree to these Terms and Conditions. Please read them carefully before scheduling service. If you have any questions, please contact us before proceeding.

1. Introduction

These Terms and Conditions ("Terms") govern your use of HVAC services provided by EcoFrost Heating and Cooling ("Company," "we," "our," or "us"), located in Mississauga, Ontario, and serving the Greater Toronto Area. By requesting our services, you ("Customer," "you," or "your") agree to be bound by these Terms.

2. Services Provided

EcoFrost Heating and Cooling provides the following HVAC services:

  • Furnace installation, repair, and maintenance
  • Air conditioning installation, repair, and maintenance
  • Heat pump and ductless mini-split services
  • Water heater installation and repair
  • Air quality products (humidifiers, filters, thermostats)
  • Red tag removal and safety inspections
  • Emergency HVAC services (24/7)

3. Estimates and Pricing

Free Estimates: We provide free estimates for new equipment installations. Diagnostic fees may apply for repair services.

Quote Validity: Written quotes are valid for 30 days from the date of issue unless otherwise specified.

Price Changes: Prices may be subject to change based on unforeseen circumstances discovered during service, such as additional repairs needed or code compliance issues. We will notify you and obtain approval before proceeding with additional work.

No Hidden Fees: Our quotes include labor and materials as specified. Any additional costs will be communicated and approved by you in advance.

4. Payment Terms

Payment Due: Payment is due upon completion of service unless otherwise agreed in writing or financing is arranged.

Accepted Methods: We accept cash, cheque, e-transfer, and major credit cards (Visa, Mastercard).

Financing: Financing options are available through Financeit for qualifying customers. Financing terms are subject to credit approval and are governed by separate agreements with the financing provider.

Deposits: A deposit may be required for equipment orders. Deposit amounts and terms will be specified in your quote.

5. Scheduling and Property Access

Appointment Windows: We provide appointment windows and will notify you when our technician is en route. We make every effort to arrive within the scheduled window.

Property Access: You must provide safe and reasonable access to the equipment requiring service. Clear the area around HVAC equipment before our arrival.

Adult Present: An adult (18 years or older) must be present during service to authorize work and provide access.

Cancellations: Please provide at least 24 hours notice for cancellations or rescheduling. Same-day cancellations may be subject to a service fee.

6. Warranties

Labor Warranty: We provide a 1-year labor warranty on all installations performed by EcoFrost Heating and Cooling.

Manufacturer Warranty: New equipment is covered by the manufacturer's warranty, which varies by product. We will register your equipment and provide warranty documentation.

Warranty Exclusions: Warranties do not cover damage caused by improper use, lack of maintenance, power surges, acts of nature, or repairs performed by unauthorized parties.

Repair Warranty: Repairs are warranted for 90 days from the date of service for the specific issue addressed.

7. Limitations of Liability

To the fullest extent permitted by Ontario law:

  • Our liability is limited to the cost of the services provided or re-performance of the service.
  • We are not liable for indirect, consequential, or incidental damages, including loss of profits or business interruption.
  • We are not responsible for pre-existing conditions, code violations, or issues unrelated to the work performed.
  • Damage to drywall, paint, or finishes may occur during equipment access; cosmetic repairs are the customer's responsibility unless otherwise agreed.

8. Customer Responsibilities

You agree to:

  • Provide accurate information about your HVAC system and service needs
  • Disclose any known issues with electrical, gas, or plumbing systems
  • Maintain your HVAC system according to manufacturer recommendations
  • Replace filters regularly as recommended
  • Ensure pets are secured during service appointments
  • Provide parking access for our service vehicles

9. Emergency Services

24/7 Availability: Emergency services are available 24 hours a day, 7 days a week, including holidays.

No Overtime Charges: We do not charge overtime rates for emergency calls. Standard service rates apply regardless of when you call.

Emergency Definition: Emergency service is intended for situations that pose immediate safety risks or result in complete loss of heating during cold weather or cooling during extreme heat.

10. Permits and Building Codes

TSSA Compliance: All gas-related work is performed by TSSA-licensed technicians and complies with Technical Standards and Safety Authority regulations.

Permits: When required by law, we will obtain necessary permits for installations. Permit costs will be included in your quote.

Code Compliance: All work is performed in accordance with the Ontario Building Code and applicable municipal bylaws.

11. Dispute Resolution

If you have a concern about our service, please contact us first. We are committed to resolving issues promptly and fairly.

Governing Law: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Jurisdiction: Any disputes shall be resolved in the courts of Ontario.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes constitutes acceptance of the modified Terms.
